Broadway Tower Cottages Terms and Conditions

We look forward to welcoming you – Here are the terms and conditions of our agreement with you. Please take the time to read them. They cover our booking policies & procedures and clarify our contractual relationship. Please let us know if we can help with more information or advice.

1. Broadway Tower Cottages

1.1 Broadway Tower Cottages (BTC) are offered for self catered holidays and are owned by Annette Gorton (the “Owner”).

1.2 In these conditions, ‘The Guest” is the person who has made reservations with Broadway Tower Cottages as the principle contact or party leader and is named on the Booking Form and Confirmation.

2. Booking Your Stay

2.1 Bookings can be made online or by telephoning 01386 852498 / 858052.

2.2 The booking is subject to the terms and conditions outlined below.

2.3 By completing the booking, the guest agrees the T&Cs on behalf of all members of the party and binds them jointly and individually to the terms therein (See Authority to Sign below).

2.4 A 25% deposit is required on booking. Should the reservation be made within 8 weeks of the holiday start date, full payment will be required on booking.

2.5 Receipt of payments confirms the Guest’s agreement to the booking terms and conditions

2.6 Receipt of payment and the resulting securing of the reservation will be confirmed by email

2.7 Booking status can be reviewed online

2.8 Payment to secure a booking is possible by bank transfer, debit or credit card

3. Balance Payment Once a booking is confirmed the Guest is liable for payment of the balance of the accommodation cost.

3.1 Balance payments are due in cleared funds 6 weeks prior to the arrival date. Guests will receive an automated email to remind them when the balance payment is due but it is the Guest’s responsibility to ensure that payment is received by the due date.

3.2 If the Balance Payment is not received by midday on the due date, the Guest authorises Broadway Tower Cottages to debit any card details held for the Guest with the appropriate charge. If funds are not available when requested, the booking shall be treated as a Cancellation by the Guest (see Cancellation Policy below)

4. Damages to the Property The Guests are liable for any damages they cause to the rented property and its contents incurrent during the course of the stay. Guests are required to report any damages or losses at the time of check-out and cover the cost of any repair or replacement within 28 days of check-out.
5. The Price of Your Accommodation All prices quoted at the point of enquiry are validated upon receipt of a booking confirmation.
6. Booking Amendments Broadway Tower Cottages will make every effort to facilitate a booking amendment. If however BTC are unable to accommodate the change the original booking will be subject to the Cancellation Policy (below).
7. Booking Cancellation Policy Once payment has been accepted for a booking this becomes a confirmed booking and charges will apply should you wish to cancel your booking. Booking Cancellation by the Guest

7.1 A booking can only be cancelled prior to the holiday start date.

7.2 A Guest wishing to cancel a booking must inform Broadway Tower Cottages in writing (email is acceptable). The cancellation takes effect from the day that the written confirmation is received.

7.3 Cancellation Charges are as follows: i) Where cancellation notice is received more than eight weeks before the booking start date the deposit will be refunded minus an administration fee of £30. ii) Where cancellation notice is received between eight weeks and one week prior to the holiday start date the deposit if forfeit unless the accommodation can be re-let. In which case all payments will be refunded minus an administration fee of £30 and any shortfall in the re-letting price. iii) Where cancellation notice is received within one week of the holiday start date all payment will be forfeit unless the accommodation can be re-let. If BTC is unable to sell any part of the cancelled period then money will be forfeit and for this reason we strongly advise Guests to obtain their own holiday cancellation insurance.

7.4 BTC shall not repay any monies due to the Guest as the result of a booking cancelled by the Guest until the whole of the cancelled period has been resold or the last day of that period is passed. Booking Cancellation by the Owner

7.5 It is extremely unlikely that the Owner cancels a confirmed booking. If however, for reasons beyond the reasonable control of the Owner, the property is no longer available the Owner reserves the right to cancel a booking. In this event, the Owner will inform the Guest as soon as possible and alternative accommodation of at least comparable standard will be sought. If this is not acceptable to the Guest and providing the cancellation does not arise from reasons of Force Majeure (Below) all monies paid by the Guest will be refunded.

7.6 By accepting the alternative property the Guest agrees to the Booking Terms and Conditions. If the alternative accommodation has a lower tariff than the original property booked the Guest will receive a refund of the difference. If the alternative property costs more than the original, the Guest will be asked to pay the difference. The Owner will not be liable for any further obligations, compensation or claims by the Guest.

8. Arrival and Departure Times The Guest is requested to adhere to the arrival (1600) and departure times (1000) listed. Changes to these times can be requested prior to arrival but are subject to confirmation from the property Owner and may incur a charge.
9. Restrictions Sadly our properties are not suitable for children under the age of 10. We love pets but unfortunately are unable to offer holiday accommodation to them.
10. Party Size and Members There are limits on the maximum number of guests that can be at a property (e.g. 4 in Oak Cottage) and the number of guests at the property must not exceed those limits except with prior written agreement from the Owner. Admittance to the property may be refused or the Guest may be asked to vacate the property immediately if this condition is not observed.
11. Additional Requirements A Guest requesting additional services such as additional cleaning, catering, activities, supermarket delivery etc., is advised to arrange these as far in advance of the arrival date as possible. Generally, a minimum of seven days prior to the arrival date is required to arrange additional services. Where sufficient notice is not given, then arrangement of additional services is dependent on availability and is not guaranteed.
12. Care of the Property

12.1. The Guest is legally obliged to take all reasonable and proper care of the property including buildings, gardens, fixtures, fittings, furniture, pictures and other effects in or around the property and shall leave them in the same state of repair and condition at the end of the rental period as found at the beginning.

12.2. In the event of any damage to property or equipment during the stay, the Guest is required to notify the Owner.

12.3. The Guest shall leave the property in a clean and tidy condition: this includes cleaning all cutlery and crockery and placing all rubbish in appropriate waste or recycling bins.

12.4. The Guest agrees to respect their surroundings and not to disturb or otherwise annoy the occupants of neighbouring properties. The Guest also agrees to adhere to any specific noise restrictions in place at the property. The Owner reserves the right to enter the property to investigate concerns relating to the care of the property or to disturbances. The Owner is within their rights to request that Guests vacate the property with immediate effect if it is found to be in a neglected or damaged condition.

13. House Books The Owner has provided a booklet of information, guide books and maps for reference during your stay. The Guest agrees to not remove these items from the property.
14. Personal belongings The Owner cannot accept any responsibility or liability for loss of or damage to any of the Guest’s personal items, belongings or vehicles, however caused.
15. Linen Sun cream, fake tan, waterproof make-up and hair dye can all cause permanent damage to bedding, linen and towels and Broadway Tower Cottages asks that the Guests do to take care when using these products. If damage / staining does occur and the items cannot be cleaned, a charge may be levied.
16. Smoking Please note that all Broadway Tower Cottages are non-smoking.
17. Insurance Broadway Tower Cottages strongly advises the purchase of holiday insurance. Guests should obtain insurance that at least includes holiday cancellation cover for the value of their booking for their own protection and peace of mind. Ideally the insurance policy will cover other eventualities such as travel and road conditions as BTC will not be liable for circumstances that may prevent you accessing the property (See Force Majeure, below).
18. Property Maintenance Issues and Complaints

18.1 The Guest must report any pre-existing damage noticed upon arrival within 24 hours.

18.2 If any issues arise during the stay the Guest should contact Broadway Tower Cottages in order to investigate and to take any remedial action.

19. Privacy Policy

19.1 Any personal information supplied to Broadway Tower Cottages is used, held or stored in accordance with the Data Protection Act 1998.

19.2 For security the full address details including comprehensive directions and key collection arrangements shall be sent upon receipt of the balance payment in full.

19.3 The Guest agrees to not, under any circumstances, exploit for commercial purposes any photographic or moving images of the property.

20. Force Majeure The Owner cannot accept any liability or pay any compensation where the performance or prompt performance of her contractual obligations is prevented or affected by circumstances amounting to force majeure. Force majeure is any event, which the Owner could not, even with all due care and attention, avoid. Such events may include war or threat of war, civil strife, natural or nuclear disaster, industrial dispute, terrorist activity, fire, adverse weather conditions, unforeseen local building or road-works, unavoidable technical problems with transport, closure or congestion of airports or ports, cancellations or changes of schedule by scheduled airlines and all similar circumstances beyond our control.
21. Breach of Contract If any of the above conditions are breached by the Guest or any member of their party, the Owner reserves the right to enter the property and request that the party leave the property with immediate effect.
22. Governing Law This agreement is governed by English law with English Courts having exclusive jurisdiction. Thank you for taking the time to read through the Terms and Conditions and we hope you have a lovely holiday.
